Jammu police have taken a strict stance against public nuisance caused by intoxication, with three individuals sentenced to community service under the Bharatiya Nyay Sanhita (BNS). This decision reflects a shift toward rehabilitation rather than punitive measures for minor offenses.

Public Nuisance Case : Accused Sentenced Community Service

On February 19, two individuals, Lekh Raj and Ashok Singh, residents of Bajalta, were caught creating a public disturbance in the Sidhra area while under the influence of alcohol. The police detained them and presented their case before the Special Excise Mobile Magistrate in Jammu on Saturday.

As per the court’s ruling under Section 355 of the BNS, both offenders were instructed to perform one hour of daily community service at a nearby hospital for 10 days. This provision aims to emphasize rehabilitation and community engagement, encouraging offenders to contribute positively to society rather than facing conventional penalties.

In another incident on February 17, Amit Mehra, a resident of Kot Garhi village, was found creating a disturbance in an intoxicated state. Following his arrest, the Mobile Magistrate directed him to perform community service at an old age home in Akhnoor for seven days, ending on February 27.

Focus on Rehabilitation Over Punishment

The enforcement of Section 355 of the BNS underscores a modern approach to minor offenses, where community service replaces traditional punitive measures. By engaging in social work, offenders gain an opportunity to reflect on their actions and reintegrate into society with a sense of responsibility.

This reformative approach aligns with India’s evolving judicial framework, prioritizing rehabilitation over strict punishment for non-violent offenses. Authorities believe such measures will help in reducing public disturbances caused by intoxication while encouraging offenders to adopt better behavior.

The recent directives by Jammu’s Special Excise Mobile Magistrate highlight a progressive legal approach under the Bharatiya Nyay Sanhita. By enforcing community service as a corrective measure, the judiciary aims to foster social responsibility and deterrence against public nuisance caused by intoxication.

As legal reforms continue to evolve, community-based penalties could become an effective tool in ensuring civic discipline while promoting social welfare. This case serves as a reminder that public intoxication and disturbances will not be taken lightly, and offenders will be held accountable through constructive community service programs.
