J&K High Court Halts Deportation of Pakistani Woman Married to CRPF Jawan

In a significant last-minute intervention, the Jammu and Kashmir High Court granted interim relief to a Pakistani national, Minal Khan, who was on the verge of being deported to Pakistan. Minal, who had married CRPF constable Munir Ahmed Khan two and a half months ago, had already left Jammu for the Attari border when her lawyer informed her about the court’s decision.

Minal entered India on a visiting visa and later applied for a long-term visa following her marriage to Munir. According to her counsel, Advocate Ankush Sharma, she had appeared for the visa interview and received favorable recommendations, which were subsequently sent to the Ministry of Home Affairs (MHA) for processing.

However, in the aftermath of the recent Pahalgam terror attack, the Indian government revoked the visas of most Pakistani nationals — except for a few under special categories. As Minal did not yet possess a long-term visa, she was directed to return to Pakistan.

“The Pahalgam attack happened, and she didn’t have a long-term visa, so she was sent to the Attari border,” said Advocate Sharma. “We moved the High Court, which issued an interim order staying her deportation. She was then brought back to Jammu and reached here around 3 a.m.”

The case highlights the legal and humanitarian complexities surrounding cross-border marriages and immigration protocols during times of heightened security.
