  • Written Agreement Required: No property can be rented without a written agreement between the landlord and tenant.
  • Registration with Rent Authority: Both parties must jointly inform the newly created Rent Authority within two months of signing the agreement.
  • Proof of Tenancy: Once registered, the information becomes conclusive proof of the tenancy details, including rent amount, duration, and deposit.

This system helps prevent verbal disputes and ensures legal protection for both sides.

2. Clear Rules for Eviction and Penal Rent

The Bill defines lawful grounds for eviction to ensure fairness and prevent arbitrary removal:

  • Non-payment of rent for two consecutive months.
  • Misuse of property, such as illegal activity or causing public nuisance.
  • Landlord’s genuine need for repairs or rebuilding.

If tenants overstay beyond the expiry of their lease, penal rent will apply:

  • Twice the monthly rent for the first two months.
  • Four times the rent thereafter until they vacate.

This rule ensures landlords can reclaim their property quickly while discouraging misuse of tenancy rights.

3. Security Deposit Limitations

To prevent exploitation through excessive deposits, the Bill introduces clear caps:

  • Residential properties: Maximum of two months’ rent as deposit.
  • Commercial properties: Maximum of six months’ rent.

Landlords are also required to refund the deposit upon vacating the property, after adjusting for unpaid rent or damages.

4. Protection of Essential Services

The law strictly forbids landlords from cutting off essential services such as electricity, water, or sanitation. If a landlord violates this rule, the Rent Authority can order immediate restoration and may award the tenant compensation up to two months’ rent.

5. Quick and Transparent Dispute Resolution

The J&K Tenancy Bill 2025 replaces the old civil court system with a three-tier dispute redressal framework designed for faster justice:

  1. Rent Authority – Registers agreements and handles minor disputes.
  2. Rent Court – Deals with eviction and possession cases.
  3. Rent Tribunal – Functions as an appellate body.

This structure ensures rental conflicts are settled efficiently without lengthy court delays, boosting public confidence in the legal process.

Additional Tenant and Landlord Protections

Right to Privacy and Entry

Landlords must provide at least 24 hours’ written notice before entering rented premises, except during emergencies. This ensures tenants’ right to privacy and peaceful enjoyment of the property.

Refund of Security Deposit

The security deposit must be refunded on the day of vacating the property after deducting legitimate dues such as unpaid rent or repair costs. This brings accountability and financial transparency.

Encouraging Real Estate Investment

By creating a fair and organized rental system, the Bill encourages investors and homeowners to rent out unused properties. This move is expected to boost the rental economy, create new business opportunities, and generate employment across sectors like property management and maintenance.
