On Thursday, the apex court reinforced that no foreign medical degree will be considered valid in India unless the candidate has cleared the NEET-UG (National Eligibility cum Entrance Test – Undergraduate) exam.

Supreme Court Upholds NEET-UG Requirement for MBBS Abroad

The ruling is aimed at maintaining the standard of medical education and ensuring the quality of healthcare services in India. The Supreme Court reaffirmed the National Medical Commission (NMC) guidelines, which mandate NEET-UG as a prerequisite for students pursuing an MBBS degree, whether in India or overseas.

The requirement of NEET-UG for medical aspirants was implemented in 2018 through an official directive issued by the NMC. The court emphasized that this rule does not violate any statutory provisions and is essential for ensuring uniformity in medical education standards.

SC Verdict: No Exemptions for Foreign MBBS Students

A bench comprising Justices B R Gavai and K Vinod Chandran clarified that students who enroll in foreign medical colleges without appearing for NEET-UG cannot claim exemption from this requirement later. The ruling underscores that candidates who knowingly take admission in foreign medical institutions without fulfilling the mandatory eligibility criteria cannot demand recognition of their degrees in India.

The bench stated:

“Obviously, with open eyes, after the amended regulations came into effect, if any candidate chose to obtain admission in a foreign institution for pursuing a course leading to a primary medical qualification, they cannot seek an exemption from the regulations, which lay down essential eligibility criteria for practicing medicine within the country. This does not restrict their right to practice anywhere outside India.”

Consequences of Pursuing MBBS Abroad Without NEET-UG

Students must be aware of the repercussions of obtaining a foreign medical degree without qualifying for NEET-UG. The consequences include:

  • Invalid Medical Degree in India: Any MBBS degree earned without NEET-UG will not be recognized for medical practice in India.
  • Ineligibility for FMGE: Candidates who fail to clear NEET-UG cannot appear for the Foreign Medical Graduate Examination (FMGE), which is necessary to practice medicine in India.
  • Risk of Fraudulent Institutions: Students might fall into the trap of unrecognized or substandard foreign medical colleges that offer degrees without proper accreditation.
  • Financial and Career Setbacks: Investing in a foreign medical degree without NEET-UG can lead to wasted time, effort, and significant financial losses.
